التحكيم التجاري الدولي international commercial arbitration
An arbitration agreement can be entered into when the dispute arises, or it can be included as a clause in a commercial agreement (main underlying contract) providing that, in the event of disagreement, some or all of the matters arising between the parties will be referred to arbitration. This means that, for arbitration to occur, the clause is triggered by a dispute arising out of the contract between the parties, with one of the parties giving notice of an intention to proceed to arbitration as provided for in that clause to the contract. Also, the general agreement to arbitrate contained in the clause typically provides that any award rendered is final and binding, and constrains the parties from commencing litigation over the subject matter of the dispute.
